Pre-contractual information on the EU Data Act from LEMKEN GmbH & Co. KG

Connected products

Our attachments and control terminals are considered "connected products" within the meaning of the EU Data Act (hereinafter referred to as "product"). We would therefore like to inform you below, in accordance with Art. 3 (2) of the EU Data Act, about the type, format, scope, and access options for this data. 

  • Data on the configuration and settings of the Product and associated software,
  • Data automatically generated by sensors and data recorded by embedded applications, including applications that indicate hardware status and malfunctions,
  • Data for determining or changing a physical quantity or property such as position and speed, pressure, flow rate, application rates, or working depths and widths, static machine parameters such as machine name and type, working width,
  • Agricultural data such as working pressures, crop types, crop yields, area size, crop activity, and data on environmental conditions,
  • Usage-related data such as activity time and duration, as well as location-related machine activities.

The data is provided in widely used, industry-standard, and standardized data formats (ISO-XML), including relevant metadata such as time and location. 

Yes, our products are capable of continuously generating data when equipped with the appropriate hardware, a LEMKEN Communication Unit LCU-1 or a CCI terminal, and the required software licenses are activated. 

Yes. There is no time limit on storage. Where personal data is concerned, the storage period depends on the type and purpose of data processing. Personal data in LEMKEN's data services is deleted once the purpose of processing has been fulfilled and there are no legal retention periods preventing deletion. 

Depending on the product's features, the user can retrieve the data directly from the product or from the connected online services. The data can be exported via the USB interface of the CCI terminal. The data automatically transferred to the CCI.Maps platform can also be exported directly from CCI.Maps. Users can log in there with their LEMKEN account and manage, download, and forward the data independently in ISO-XML format. 

LEMKEN uses the market-established Agrirouter as a tool to promote interoperability and cross-manufacturer data exchange. This allows data to be transferred to connected systems in near real time. Access to the Agrirouter is non-discriminatory. The data is exported in the ISO11783. A definition of the individual data can be found in our data dictionary at https://www.isobus.net/isobus. ISOXML Taskdata is a standardized data format in accordance with ISO11783 Part 10, which is used to describe and document agricultural work orders. It is used by task controller systems (TC) to store machine configurations, target values, actual values, and geometries and to exchange them between FMIS, terminals, and machines.

Related services

Our CCI.Maps data services (hereinafter referred to as "services") are also covered by the EU Data Act as connected services. We would therefore like to inform you about our services in accordance with Art. 3 (3) of the EU Data Act. 

LEMKEN receives the data described above as part of the provision of the CCI.Maps   data services.  The data is transmitted several times per minute, depending on various factors such as driving speed, machine status, and network quality.

The type and scope of the service data collected depends on the use of the online services and, in particular, on user behavior. This includes all machine data as well as data that the user adds to CCI.Maps through interaction, e.g., operating information, information on machine use, and field boundaries.

The data is stored in the CCI.Maps data services and made available to Agrirouter from there. From there, the user can share the data with any third party. The data can be exported via CCI.Maps. The future data owner is then responsible for determining the storage and retention modalities. For details on access and retrieval options, see above (CCI.Maps Export).

LEMKEN may use the data to improve and further develop the product and related services, as well as to develop new comparable products and related services. LEMKEN may also use the data to offer its customers additional services and dashboards.

With the consent or at the request of the farmer, LEMKEN may make the data available to third parties under the contractually agreed conditions.

Data is transferred via Agrirouter (https://agrirouter.com/). Users can also stop data transfer at any time via the Agrirouter portal.

According to Art. 37 of the Data Act, you have the right to lodge a complaint with the authority responsible for monitoring compliance with the Data Act in Germany in the event of a violation of any of the provisions of the Data Act. 

No, the above-mentioned data does not contain any trade secrets. If the requested data contains trade secrets, these will be protected by additional measures and the user will be informed accordingly. 

The contract term and conditions (including duration and termination) are governed by the agreements in the contract concluded between LEMKEN and the user. This contract ends when the user is no longer the owner or contractually entitled to use the product and/or the associated services.
